1.Purpose and acceptance
These Terms and Conditions govern the tourism-intermediation services offered by The Colombia Travels (hereinafter, "the Agency") through its website and other contact channels. Confirming a booking or paying a deposit or the full amount of a service implies full acceptance of these conditions by the customer (hereinafter, "the Traveler").
2.Role of the Agency
The Agency acts as an intermediary between the Traveler and the actual providers of the tourism services (airlines, hotels, wholesale operators, guides and local experience operators). The Agency does not directly provide the air transport, accommodation or activities booked: it selects, quotes and manages the booking of those services on the Traveler's behalf.
This intermediary role does not exempt the Agency from its duty of care: the Agency commits to selecting reliable providers, to accurately informing the conditions of each service, and to actively managing any issue that arises with a provider, as detailed in Section 6.
3.Services offered
The Agency offers three types of services, which may be booked independently or combined:
- Flights: searching for and booking air tickets with different airlines.
- Packages: a combination of flight and accommodation, and in some cases transfers, quoted as a single unit.
- Experiences: excursions, tours and activities operated by local guides or tour operators.
4.Payment terms
Quoted prices are subject to availability and confirmation by the provider at the time the booking is issued; a quote does not constitute a confirmed booking until the corresponding payment has been registered.
Payment may be made through Mercado Pago (for travelers within Argentina) or PayPal (for travelers outside Argentina), under the conditions — currency, installments, deadlines — stated in each quote. The Agency may require full or partial payment (a deposit) depending on the corresponding provider's conditions.
Once a booking has been confirmed with the provider, any later change in fares, fees or taxes set by that provider may be passed on to the Traveler, and will be communicated in advance.
5.Booking confirmation
The Agency will send the Traveler, by email, the booking documentation (confirmation code, itinerary, vouchers as applicable) once payment has been confirmed. It is the Traveler's responsibility to check that their personal and trip details are correct and to report any error promptly, since correcting it afterward may be subject to charges from the provider.
6.Changes, cancellations and refunds caused by third parties
In the event of a cancellation, delay or change made by the airline, hotel or operator (and not by the Agency), the following rules apply:
- Primary responsibility for fulfilling the booked service rests with the actual provider (airline, hotel or operator), under its own terms of service and the regulations that apply to it.
- The Agency commits to actively managing, on the Traveler's behalf, any claim, rebooking or refund request with the corresponding provider, and to keeping the Traveler informed throughout that process.
- The Agency does not guarantee the outcome or timeline of such processes, since these depend on the provider's own policies and timeframes, but commits to acting diligently and not remaining inactive in the face of a claim.
- Where applicable law establishes joint liability between the Agency and the provider, the Agency will act in accordance with that law.
7.Cancellations by the Traveler
If the Traveler wishes to cancel or change an already-confirmed booking, the corresponding provider's cancellation conditions will apply (which may include non-refundable charges), plus, where applicable, the Agency's own management fees, which will be disclosed before the booking is confirmed.
8.Travel documentation and requirements
It is the Traveler's sole responsibility to have the documentation required to travel (valid passport, visas, permits, health requirements or others) for the chosen destination. The Agency may provide general guidance on this, but is not responsible for issues arising from the Traveler's failure to meet these requirements.
9.Limitation of liability
The Agency's liability is limited to the intermediation, advisory and management services described in this document. The Agency is not liable for matters outside its direct control, including but not limited to: operational decisions by airlines or operators, weather conditions, strikes, government measures, or other cases of force majeure — without prejudice to the duty of active management set out in Section 6 and to any applicable consumer-protection regulations.
10.Force majeure
Neither party will be liable for failing to fulfill its obligations when this is due to force-majeure circumstances beyond its control, that are unforeseeable or unavoidable.
11.Personal data protection
Personal data provided by the Traveler will be used solely to manage the booking and to communicate about the service booked, and will not be shared with third parties unrelated to that management, except where legally required.
12.Changes to these Terms
The Agency may modify these Terms and Conditions at any time. Changes will apply to bookings made after their publication; bookings already confirmed will be governed by the terms in force at the time they were booked.
13.Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic, including Consumer Protection Law No. 24,240. For any dispute, the parties submit to the competent courts of the Argentine Republic, without prejudice to any venue that consumer-protection regulations provide in the Traveler's favor.
14.Contact
For any question about these Terms and Conditions or about an ongoing booking, the Traveler may write to info@thecolombiatravels.com.
